Uluslararası Ceza Mahkemesi için Uluslararası Koalisyon -The Coalition for the International Criminal Court (CICC) Cezayir’i Uluslararası Ceza Mahkemesi kurucu statüsü olan Roma Statüsü’nü onaylayarak UCM’nin yargı yetkisini tanımaya davet ediyor. Cezayir, UCM’nin kuruluşu için 1998 yılında Roma’da düzenlenen BM Diplomatik Konferansına aktif olarak katıldıktan sonra 28 Aralık 2000 tarihinde UCM Roma Statüsü’nü imzalamış ancak onaylama işlemini gerçekleştirmemiştir. Ortadoğu ve Kuzey Afrika Bölgesi, bugüne kadar UCM’de en az temsil edilen bölge olmuştur. 22 Arapça konuşan ülkeden oluşan Arap Birliği’nin içinde sadece 3 ülke Roma Statüsü’nü onaylamış ve mahkemeye taraf olmuştur. Bu ülkeler Ürdün, Cibuti ve Komor Adaları’dır. Bölgede 12 ülke ise statüye imzacı durumundadır. Bölgede büyüyen bir insan hakları hareketi vardır ve uluslararası koalisyona üye 300’ü aşkın yerel örgüt bulunmaktadır. Uluslararası Koalisyon, bu alanda çalışan tüm örgütlerin çabasına ek olarak, Cezayir’i bir an evvel Roma Statüsü’nü onaylamaya ve soykırım, insanlığa karşı suçlar ve savaş suçlarıyla ilgili olarak, uluslararası hukukun en ağır ihlallerine yol açan kişileri yargılamak üzere kurulmuş bulunan ilk bağımsız ve daimi mahkeme olan Uluslararası Ceza Mahkemesi’ne tam destek vermeye davet etmektedir. I am writing to urge you to ensure the intensification of Algeria’s ratification process to the Rome Statute of the International Criminal Court (ICC). The Court’s first cases in Uganda, Central African Republic, the Democratic Republic of Congo and Sudan signify that it is moving forward in its crucial work to end impunity for genocide, crimes against humanity, and war crimes.
Algeria played a positive role in drafting the Rome Statute and signed it on 28 December 2000. As you well know, the Rome Statute came into force in July 2002 and 110 states have ratified or acceded to the ICC Treaty and 139 are signatories. The ICC is an important tool that will ensure that the most serious international crimes no longer go unpunished. Arab and African nations are instrumental in building and strengthening this new justice system, and their support to the ICC is vital to the fight against impunity.
Algeria and the Arab and African States are instrumental to building this system of international justice and their support for the ICC is vital to its long-term success and efficiency. The Middle East and North Africa (MENA) region is underrepresented in the ICC. The League of Arab States has but three members that are States Parties to the Rome Statute, and twelve that have signed it. The African Union has 30 States Parties.
Algeria should ratify the Rome Statute as soon as possible and fully align legislation with all obligations under the Rome Statute, including ratification of the Agreement on Privileges and Immunities of the ICC. It should join the rest of the world in the determination to cooperate for the prevention of genocide, crimes against humanity, and war crimes and to put an end to impunity of perpetrators thereof, by adhering to the new system of international justice created by the Rome Statute.
